Statutory Language — On the left side we have provided you with the actual language from the statute. All of the bolded language is new language. The right side contains the summary of the new provisions, which includes important key points, some special notes to consider, relevant state requirements and more user-friendly language.
Flow Chart — We have developed this Placement in Disciplinary Procedures flow chart in order to help you keep track of the relevant timelines and overlapping courses of action concerning disciplinary action taken against students with disabilities. It is to be read in conjunction with state law requirements under M.G.L. c. 71, §§37H and 37h1/2. Note that the change in placement procedures are only triggered after a disciplinary hearing has resulted in a finding that a student with a disability did in fact violate a school code of conduct.
