The Massachusetts Department of Elementary and Secondary Education (DESE), Office for Food and Nutrition Programs (FNP) is responsible for ensuring that the Sponsoring Organizations (SO) comply with the Civil Rights Requirements outlined in FNS Instruction 113-1 and the 2016 Memorandum of Understanding between United States Department of Agriculture Food and Nutrition Service Civil Rights Division (FNS CRD) and the DESE. These requirements outline basic standards for processing and tracking covered complaints of discrimination and identifies resources and guidance available to support SO's Civil Rights program. SO's must have their own process for receiving, communicating, and resolving all Civil Rights complaints. These policies and procedures should at minimum include a process that does not hinder the submission of a complaint, ensures any complaints that involve a federally protected class and Child Nutrition Programs (CNP) be referred to FNS CRD within 5 days of receipt and the complaint is logged in their CNP specific Civil Rights complaint log.
Included in this memorandum are templates that SO can use in part or in whole during the development of their local policy/procedures. Policy and procedure(s) must be kept on file and documents may be requested as part of a review.
Insert Sponsoring Oranization's Name will comply with the Civil Rights Requirements outlined in FNS Instruction 113-1 and the 2016 Memorandum of Understanding between United States Department of Agriculture Food and Nutrition Service Civil Rights Division and the Massachusetts Department of Elementary and Secondary Education, Office for Food and Nutrition Programs. If a participant, parent/guardian, or potential participant reports a concern that involves a federally or state protected class we will inform, accept, document, and share the complaint or concern in accordance with the procedures outlined here.
Inform: the person to whom potential discrimination may have or perhaps they feel have potentially occurred and their right to file an official complaint. Consider if parental/guardian notification is appropriate.
Accept: an official complaint in any form.
Document: The complaint in a complaint log specific to Child Nutrition Programs.
Share: The complaint within 5 days with FNS CRD.
